This policy explains what personal data we collect through theforestscape.com, why we collect it, who we share it with, and the choices you have. It applies to enquiries, site-visit bookings, and payments made on this website.

  1. SCOPE AND APPLICABLE LAW

Swagatham Constructions Private Limited ("the Company", "we", "us") is the data fiduciary in respect of personal data collected through this website. We handle personal data in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023, as and when its provisions are brought into force.

  1. DATA WE COLLECT

Contact data
What it includes: Name, mobile number, email address, city, country of residence.
When we collect it: Enquiry form, chat, phone call, site visit register, campaign lead form.

Requirement data
What it includes: Unit type preference, budget range, timeline, purpose (own use or investment), how you heard of us.
When we collect it: Enquiry and pre-sales conversation.

Booking and KYC data
What it includes: PAN, Aadhaar or passport, address proof, date of birth, co-applicant details, nominee details, bank details for refund.
When we collect it: Only after you decide to book a unit.

Transaction data
What it includes: Amount, date, order and transaction reference, payment status, last four digits and instrument type as returned by the gateway.
When we collect it: When you make a payment.

Technical data
What it includes: IP address, device and browser type, operating system, referring URL, pages viewed, time on page, click identifiers.
When we collect it: Automatically, when you browse.

Communication records
What it includes: Emails, WhatsApp messages, and recordings of calls with our sales team.
When we collect it: During your interactions with us.

We do not collect or store card numbers, CVV, expiry dates, UPI PINs or net-banking credentials. Those are captured directly by our PCI-DSS compliant payment gateway partner. We receive only the transaction outcome and a masked reference.

Call recording: Calls with our sales and pre-sales team may be recorded for quality, training and record-keeping. You will be informed at the start of the call and may decline.

  1. WHY WE USE YOUR DATA

  • To respond to your enquiry, share project information, and schedule site visits.

  • To process bookings, verify identity, meet KYC obligations, issue receipts and demand letters, and register the Agreement to Sell.

  • To process payments and refunds, and to investigate failed or disputed transactions.

  • To meet legal obligations under the Real Estate (Regulation and Development) Act, 2016, tax law, anti-money-laundering law, and directions of any competent authority.

  • To send you project updates, construction progress, pricing changes and offers, where you have consented.

  • To measure and improve our marketing, including on Meta and Google platforms.

  • To detect and prevent fraud, and to secure our systems.

  1. CONSENT TO BE CONTACTED

When you submit your mobile number through this website, you consent to being contacted by the Company and its authorised channel partners by phone, SMS, WhatsApp and email regarding your enquiry and our projects. This consent overrides any registration you hold on the National Do Not Call registry, and you will not treat such communication as an unsolicited commercial communication.

You may withdraw this consent at any time by writing to grievance@futureisone.com or by replying STOP to any marketing message. Withdrawal does not affect communication that is necessary to service a booking you have already made.

  1. COOKIES AND TRACKING

We use cookies and similar technologies to keep the site working, remember your preferences, and understand how the site is used. These include:

  • Essential cookies - required for page delivery, form submission and security.

  • Analytics cookies - Google Analytics, to understand traffic sources and page performance in aggregate.

  • Advertising cookies and pixels - the Meta Pixel and Google Ads tags, which allow us to measure campaign performance and show you relevant advertising on Facebook, Instagram, YouTube and partner sites.

  • Conversions API - we may send hashed, non-reversible versions of your contact details to Meta and Google, server-side, to attribute an enquiry to the campaign that produced it.

You can block or delete cookies through your browser settings. If you block essential cookies, parts of the site may stop working. You can manage advertising preferences at facebook.com/adpreferences and adssettings.google.com.

  1. WHO WE SHARE YOUR DATA WITH

We do not sell your personal data. We share it only as follows:

  • Group entities - Future Is One Private Limited and associated Aiikya project entities, where you have enquired about more than one project.

  • Service providers - our CRM provider, cloud hosting provider, telephony provider, WhatsApp business solution provider, email service provider and analytics providers, each bound by contract to use the data only for the services they provide to us.

  • Payment partners - the payment gateway and the acquiring and collecting banks, to process a payment or a refund.

  • Authorised channel partners - where your enquiry originated with a registered channel partner, for the limited purpose of servicing that enquiry.

  • Banks and housing finance companies - only where you ask us to facilitate a home loan.

  • Professional advisers - advocates, chartered accountants and auditors, under confidentiality obligations.

  • Authorities - the Karnataka RERA, tax authorities, the sub-registrar, law enforcement and any court, where required by law or by a valid order.

  1. CROSS-BORDER TRANSFER

Some of our service providers store data on servers located outside India. Where personal data is transferred outside India, we ensure that the recipient is bound by obligations comparable to those in this policy, and the transfer is made in accordance with applicable Indian law.

  1. SECURITY

We follow reasonable security practices in line with the IS/ISO/IEC 27001 standard referenced in the SPDI Rules, 2011. These include access control on a need-to-know basis, encryption in transit over HTTPS, restricted administrative access, and confidentiality obligations on employees and vendors. No system is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal data occurs, we will notify you and the competent authority as required by law.

  1. HOW LONG WE KEEP DATA

  • Enquiries that do not convert - up to 36 months from last contact, then deleted or anonymised.

  • Booking, KYC and transaction records - for the period required under the Companies Act, 2013, the Income-tax Act, 1961, the GST law and the RERA Act, and in any case not less than 8 years from the end of the relevant financial year.

  • Call recordings - up to 12 months, unless required longer for a dispute.

  1. YOUR RIGHTS

Subject to applicable law, you may ask us to:

  • confirm what personal data of yours we hold, and give you a summary of it;

  • correct or update data that is inaccurate, incomplete or out of date;

  • erase data that we no longer need for a lawful purpose;

  • withdraw a consent you previously gave;

  • nominate a person to exercise these rights on your behalf in the event of your death or incapacity.

Write to grievance@futureisone.com from your registered email address. We will verify your identity and respond within 30 days. Some data cannot be erased where we are required by law to retain it.

  1. CHILDREN

This website is not directed at children. We do not knowingly collect personal data of a person below 18 years of age other than as a co-applicant or nominee, with the consent of a parent or lawful guardian. If you believe we hold such data without valid consent, write to us and we will delete it.

Complaints are acknowledged within 48 hours and resolved within 30 days. If you are not satisfied with our response, you may approach the Data Protection Board of India once constituted, or the appropriate consumer forum.

We may update this policy to reflect changes in our practices or in the law. The current version, with its effective date, is always published on this page. Material changes will be notified by email to customers with an active booking.
