This policy explains how a booking or an allotment at Aiikya Forestscape can be cancelled, by you or by us, and what happens to the money paid. Read it with the Refund Policy.

  1. STAGES OF A TRANSACTION

Different rules apply at each stage. Identify your stage before reading further.

Stage A - Booking
You have paid a booking or token amount. No allotment letter has been issued.
Governed by: this policy.

Stage B - Allotment
An allotment letter has been issued. The Agreement to Sell has not been executed.
Governed by: this policy and the allotment letter.

Stage C - Agreement
The Agreement to Sell has been executed and registered.
Governed by: the Agreement to Sell read with the RERA Act, 2016.

  1. CANCELLATION BY YOU

Stage A - within 7 calendar days of the booking payment
You may withdraw the booking for any reason. The booking amount is refunded in full, less only the payment gateway charges actually incurred. No administrative charge is levied.

Stage A or B - after 7 days, before the Agreement to Sell
You may withdraw the booking by written request. We retain an administrative charge of 10% of the booking amount, together with the payment gateway charges, and refund the balance. The unit is released to inventory on the date we receive your written request.

Stage C - after the Agreement to Sell is executed
Cancellation is governed by the cancellation clause of the executed Agreement to Sell and by section 19 of the Real Estate (Regulation and Development) Act, 2016. Typically the Company is entitled to forfeit an amount not exceeding 10% of the total consideration, together with the applicable interest and any brokerage already paid, and to refund the balance. Statutory amounts already deposited with the government, including GST, stamp duty and registration charges, are not refundable by the Company.

HOW TO CANCEL: Send a signed written request to crm@futureisone.com, copying sales@futureisone.com, stating your name, unit number, booking reference, date and amount of payment, and the reason. A cancellation takes effect from the date we receive the written request, not from the date of a phone call.

  1. CANCELLATION BY US

We may cancel a booking or an allotment where:

  • you fail to pay an amount within 30 days of its due date, after a written reminder and a further notice giving you at least 15 days to remedy the default;

  • you fail to execute and register the Agreement to Sell within the period stated in the allotment letter;

  • you fail to furnish the KYC documents required by law;

  • the information you gave us is found to be false or materially misleading, or the payment is found to be from an unlawful source;

  • a payment is reversed, dishonoured or charged back and is not made good within 15 days.

Where we cancel for any of these reasons, the deductions in Clause 2 apply according to the stage reached, and interest accrued at the rate prescribed under the RERA Act may be adjusted against the amount refundable.

We may also cancel where the unit becomes unavailable, or a sanction or approval changes such that the unit cannot be delivered as booked. In that case the entire amount paid is refunded in full without any deduction, and you may instead choose an alternative available unit.

  1. PROCESS AND TIMELINES

Acknowledgement of your cancellation request: within 2 working days.
Confirmation of the cancellation and the settlement statement: within 7 working days.
Refund initiated after settlement is agreed: within 7 working days.
Credit to your account: 5 to 10 working days after initiation.
Deed of cancellation, where the Agreement to Sell was registered: executed before refund; registration charges as per the agreement.

Where the Agreement to Sell has been registered, a registered deed of cancellation must be executed before the refund is released, and the cancellation must be reflected in the Company's RERA filings.

  1. TRANSFER INSTEAD OF CANCELLATION

Instead of cancelling, you may apply to transfer or nominate the booking to another person, subject to our written approval, the transferee's KYC, all dues being cleared, and payment of the applicable transfer charge of 2% of the total consideration plus GST. Approval is at the Company's discretion and is not available where the account is in default.

  1. YOUR RIGHTS ARE PRESERVED

Nothing in this policy limits your rights as an allottee under the Real Estate (Regulation and Development) Act, 2016, including your right to withdraw from the project and claim a refund with interest if the promoter fails to complete or hand over possession as agreed, or your rights under the Consumer Protection Act, 2019.

  1. CHANGES TO THIS POLICY

We may revise this policy. The version in force on the date of your booking is the version that applies to it.
